Terms of Service
These Terms of Service (the “Terms”) govern your access to and use of the Appeak platform, including the website at appeak.net, our dashboard, our APIs, and any related services (collectively, the “Services”). By creating an account or using the Services, you agree to these Terms.
1. Who we are
Appeak is an App Store Optimization (ASO) growth platform that provides real-device keyword installs, ratings, reviews, and rank tracking for mobile apps published on the Apple App Store and Google Play. When we say “Appeak”, “we”, “us”, or “our”, we mean the entity providing the Services. When we say “you”, we mean the individual or organisation that holds an Appeak account.
2. Eligibility and account
You must be at least 18 years old and able to enter into a binding contract to use the Services. By creating an account, you confirm that all information you provide is accurate and that you are authorised to act on behalf of any organisation you represent.
You are responsible for keeping your login credentials secure, for all activity on your account, and for any orders placed using your wallet balance.
3. The Services
Appeak provides the following on-demand services through the dashboard and API:
- Keyword and package installs delivered by real users on real devices in the country and store of your choice
- Ratings and reviews placed by real regional accounts, subject to the policies of the relevant app store
- Daily keyword rank tracking, snapshot history, and competitor analysis tools
- Wallet, top-up, and invoicing functionality for managing campaign spend
We use commercially reasonable efforts to deliver every order according to its agreed schedule and volume. We rely on a network of third-party suppliers to fulfil installs, ratings, and reviews, and delivery times may vary.
4. Pricing, wallet, and refunds
Pricing is published at appeak.net/pricing and may be updated from time to time. Tier-based discounts apply automatically based on cumulative lifetime top-ups and never fall back.
Orders are paid from your wallet balance at the moment the order is placed. Top-ups are non-refundable to your original payment method once the funds have been credited to your wallet; however, all funds remain available to spend on Services indefinitely.
If we cannot deliver an order in full, the undelivered portion is automatically refunded back to your wallet. You may pause or cancel an order at any time before completion, and any undelivered units will be refunded in the same way.
Reviews placed under a review order are warranted to remain live for a minimum of 10 days from delivery. If any review is removed within that window, we will replace it with a new review at no additional cost. The 10-day warranty applies only to reviews; ratings and installs are delivered as one-time placements and are not eligible for replacement after delivery.
5. Your responsibilities
By using the Services you agree that you will not:
- Place orders for apps you do not own or are not authorised to promote
- Use the Services for any app that infringes intellectual property, distributes malware, or otherwise violates the policies of the App Store or Google Play
- Reverse-engineer, scrape, or attempt to gain unauthorised access to the dashboard, the API, or any underlying infrastructure
- Resell or sublicense the Services without an active reseller agreement with us
- Misrepresent your identity, evade fraud-detection measures, or use the Services to deceive third parties
6. App store compliance
App store policies on incentivised activity, paid reviews, and rank manipulation evolve over time and are interpreted at the discretion of Apple and Google. We design our delivery to behave as indistinguishably from organic user activity as we can, but we do not guarantee that any specific order will avoid app store action against your listing.
You are responsible for assessing the compatibility of the Services with the policies that apply to your app and for the consequences of using the Services for your listing.
7. Service availability and changes
We aim to provide the Services 24/7 and target high availability, but we do not warrant uninterrupted access. We may modify, suspend, or discontinue any feature of the Services at any time, with reasonable notice where practical.
8. Intellectual property
The Appeak platform, brand, dashboard, and underlying technology are owned by us. We grant you a non-exclusive, non-transferable, revocable licence to use the Services for the lawful operation of your own app marketing activities. You retain all rights to the apps and content you provide to us in connection with the Services.
9. Confidentiality
Both parties agree to treat any non-public information disclosed under these Terms as confidential and to use it only for the purpose of operating the Services or evaluating future business between the parties.
10. Liability
The Services are provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Services is limited to the amount you have spent with us in the twelve months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue, loss of data, or loss of app store ranking.
11. Termination
You may stop using the Services at any time. We may suspend or terminate your account if you breach these Terms, if your activity puts the platform or other customers at risk, or if required by law. On termination, any remaining wallet balance is forfeited unless we agree otherwise in writing.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Services or in applicable law. We will notify active customers of material changes by email or via the dashboard. Continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
